Introduction

The Notaryous LLC ("we," "our," or "us") is committed to protecting the privacy and security of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our notary and fingerprinting services, whether in-person, mobile, or through remote online notarization (RON). By using our services, you agree to the collection and use of information in accordance with this policy.

Information We Collect

Personal Information

For Notary Services: full legal name; current address; government-issued identification information; signature; contact information (phone, email); document details and transaction information; and for RON, biometric data, audio-visual recordings, and credential analysis data.

For Fingerprinting Services: full legal name; date of birth; Social Security Number (if required by the submitting agency); contact information; fingerprint biometric data; purpose of fingerprinting; and submitting agency information.

Payment Information: credit/debit card information (processed through secure third-party payment processors); billing address; and transaction history.

Information Collected Automatically

IP address (for RON sessions); device information and browser type (for RON sessions); session recordings (RON only); and website usage data (cookies, analytics).

How We Collect Information

We collect personal information when you submit a contact form on our website, book an appointment through our online scheduling system, contact us directly via phone or text, provide information to us in person, or use our remote online notarization services.

How We Use Your Information

We use your information to perform notarial acts in compliance with state law; process fingerprinting and submit to appropriate agencies; verify your identity through credential analysis and knowledge-based authentication; maintain required records (notarial journals, RON recordings); process payments; communicate with you about appointments, service updates, and reminders; improve our services through feedback and analytics; comply with legal obligations and lawful requests; and send marketing communications only with your separate consent.

SMS/Text Messaging Consent and Privacy

By providing your mobile phone number, you consent to receive SMS/text messages from The Notaryous LLC related to your appointments, service updates, reminders, and customer service communications. Message frequency may vary; message and data rates may apply; consent is not a condition of purchase; and we do not send promotional or marketing SMS messages.

How we obtain consent: when you submit your phone number through our website contact form, book an appointment online, contact us by phone or text, or provide your phone number in person for service-related communication.

A2P 10DLC — Mobile Information Sharing: No mobile information will be shared with third parties/affiliates for marketing or promotional purposes. All other categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties except as follows. We may share mobile phone numbers with SMS service providers (such as Twilio, EZ Texting, or similar platforms) solely to deliver appointment reminders, service updates, and communications you have consented to receive. These subcontractors are contractually obligated to use your mobile information only to deliver messages on our behalf, protect it with appropriate security measures, not use it for their own purposes, and not share it with any other parties. Your text-messaging opt-in data will never be sold, rented, or shared with any third party for any purpose.

Information Sharing and Disclosure

We DO NOT sell, rent, or trade your personal information to third parties for their marketing purposes; share your information with affiliates, partners, or subsidiaries for marketing or promotional purposes; or disclose your information to third parties for their commercial benefit. The Notaryous LLC operates as an independent business with no affiliates or parent companies.

We may share your information only in limited circumstances: Service Completion (title companies, lenders, or escrow companies for loan signings; government agencies for apostille processing; background-check agencies for fingerprint submission — only the minimum information necessary); Legal Requirements (when required by law, court order, or legal process; to protect our rights, property, or safety; to comply with regulatory investigations); Business Operations (professional liability insurance providers, legal counsel, payment processors such as Stripe and Square, and SMS service providers for message delivery only); and With Your Consent.

Data Security

We implement appropriate technical and organizational security measures, including physical security (secure storage of paper records in locked cabinets), digital security (encryption, password protection, secure servers), RON security (end-to-end encrypted sessions, tamper-evident recordings), fingerprint security (secure transmission to agencies, immediate destruction of local copies), access controls (need-to-know basis), and PCI-DSS compliant payment processing. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

Data Retention

Notarial journals: minimum 10 years as required by state law. RON audio-visual recordings: 10 years as required by state law. Fingerprint records: only until successful transmission to the requesting agency (typically 24–48 hours). Financial records: 7 years for tax and accounting purposes. SMS opt-in records: 5 years minimum for compliance. General business records: as long as reasonably necessary. After the retention period expires, we securely destroy or anonymize your information.

Your Privacy Rights

Depending on your location, you may have rights to access and correct your personal information, request deletion (subject to legal retention requirements), and opt out of marketing communications and certain data-collection practices (reply STOP to any text to unsubscribe).

California Residents (CCPA/CPRA)

California residents have additional rights, including the right to know what personal information is collected, the right to know if personal information is sold or shared, the right to delete personal information (subject to exceptions), and the right to opt out of the sale of personal information (we do not sell personal information). Due to legal requirements governing notarial records, we may not be able to delete certain information related to notarial acts even upon request; fingerprinting information is deleted immediately after agency submission.

Remote Online Notarization (RON)

Sessions are recorded via audio and video as required by Oregon and Washington law; identity verification uses credential analysis and knowledge-based authentication; recordings are securely stored for the required 10-year retention period; third-party RON platforms (Blue Notary) maintain their own privacy policies and must comply with state RON laws; and your biometric data from identity verification is stored securely and not shared except as required by law.

Children's Privacy

Our services are not directed to individuals under 18. We do not knowingly collect personal information from minors without parental consent, except as required in the performance of notarial duties.

Third-Party Links and Services

Our website or communications may contain links to third-party websites or references to third-party services. We are not responsible for their privacy practices. Third-party services we may use include payment processors (Stripe, Square), RON platforms (Blue Notary), SMS providers (for text delivery only), and background-check agencies (for fingerprint submission).

Changes to This Privacy Policy

We may update this Privacy Policy periodically. We will notify you of material changes by posting the updated policy, updating the "Last Updated" date, sending email notification for significant changes (if you have provided your email), and sending text notification if changes affect SMS practices (if you have opted in). Continued use of our services after changes become effective constitutes acceptance of the revised policy.
