Acceptance of Terms
Welcome to The Notaryous LLC. By engaging our services, whether in-person, mobile, or through remote online notarization (RON), you ("Client," "you," or "your") agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you and The Notaryous LLC ("we," "us," or "our").
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICES.
Services Provided
The Notaryous LLC provides the following services:
Notary Services
Mobile notary services (traveling to your location in the Portland Metro area)
Remote Online Notarization (RON) via Blue Notary platform
General notarization (acknowledgments, jurats, oaths, affirmations)
Loan signing services
Estate planning document notarization
Apostille services
Notarization for incarcerated individuals (when permitted by facility)
Witness services
Fingerprinting Services
Live scan fingerprinting
Ink fingerprinting
FBI background checks
State background checks
Professional licensing fingerprinting
Employment screening fingerprinting
Service Areas: Portland Metro area, Oregon statewide, and Clark County, Washington.
Professional Qualifications
The Notaryous LLC is:
Licensed Notary Public commissioned in Oregon and Washington
NNA (National Notary Association) Certified
LSS (Loan Signing System) Certified
Insured with $100,000 Errors & Omissions (E&O) Insurance
Background checked and bonded as required by state law
Client Responsibilities
For Notary Services
You agree to:
Provide Valid Identification: Present current, government-issued photo identification (driver's license, passport, state ID, military ID) at the time of service
Be Physically Present: Appear in person for mobile services or be present online for RON sessions (no third-party representation)
Sign Willingly: Execute documents of your own free will, without coercion or duress
Understand Documents: Have read and understand the documents you are signing (we cannot provide legal advice)
Provide Complete Documents: Ensure all documents are complete and ready for notarization
Be of Sound Mind: Be mentally competent and aware of the nature of the transaction
Provide Accurate Information: Give truthful information during the notarization process
Meet Technical Requirements (RON): Have a working device with camera, microphone, and stable internet connection
Arrive on Time: Be available at the scheduled appointment time or notify us of delays
Provide Safe Location: For mobile services, provide a safe, well-lit location suitable for conducting business
For Fingerprinting Services
You agree to:
Provide Valid Identification: Present government-issued photo ID
Provide Required Information: Complete all required forms with accurate information
Follow Instructions: Comply with fingerprinting procedures and technician instructions
Clean Hands: Ensure hands are clean and dry for best print quality
Understand Purpose: Know what agency is requesting your fingerprints and for what purpose
Limitations of Service
What We DO NOT Do
As a Notary Public, we CANNOT:
Provide legal advice or interpret documents
Recommend what type of notarial act you need
Prepare legal documents (unless specifically requested as a separate service)
Notarize documents where we have a beneficial interest
Notarize incomplete documents
Notarize for individuals who cannot be properly identified
Notarize for individuals who appear to be under duress or lack capacity
Notarize documents with blank spaces (unless specifically permitted)
Guarantee document acceptance by third parties
As a Fingerprinting Service, we CANNOT:
Guarantee fingerprint quality acceptance by receiving agencies
Provide legal advice regarding background check results
Modify or falsify fingerprint records
Guarantee processing times by receiving agencies
Appointment Scheduling and Cancellations
Scheduling
Appointments can be scheduled via phone, email, or online booking
We require at least 24 hours' notice for mobile appointments when possible
Same-day and emergency services may be available for an additional fee
Availability is subject to our schedule and geographic location
Cancellation Policy
Client Cancellations:
24+ Hours Notice: Full refund or free rescheduling
Less than 24 Hours: 50% cancellation fee
No-Show: Full service fee charged
RON Sessions: Must cancel at least 2 hours in advance to avoid fees
Our Cancellations:
We reserve the right to cancel appointments due to unsafe conditions, weather, or unforeseen circumstances
Full refund will be issued for any appointment we cancel
Late Arrivals:
Mobile Service: If we arrive at the scheduled time and you are unavailable, a $25 trip fee applies
RON Sessions: If you are more than 15 minutes late, the session may be cancelled and rescheduled with fees applied
SMS/Text Messaging Communication
Consent to Receive Text Messages
By providing your mobile phone number to The Notaryous LLC, you expressly consent to receive text messages (SMS/MMS) from us. These messages may include:
Transactional Messages:
Appointment confirmations and reminders
Service status updates
Scheduling changes or cancellations
Payment receipts and confirmations
Important service-related notifications
Emergency communications regarding your appointment
Marketing Messages (with separate opt-in):
Promotional offers and discounts
Service announcements
Educational content about notary and fingerprinting services
Business updates and news
Message Frequency
Transactional messages: Variable frequency based on your scheduled appointments and service usage
Marketing messages: Approximately 2-4 messages per month (you must opt-in separately for these)
You will not receive marketing messages unless you explicitly opt-in to receive them.
Standard Rates Apply
Standard message and data rates from your mobile carrier may apply to all text messages sent and received. The Notaryous LLC is not responsible for any charges incurred from your mobile carrier. Please contact your carrier for details about your messaging plan.
Opt-Out Instructions
You may opt out of receiving text messages at any time by:
Reply STOP: Text "STOP" to any message from us to unsubscribe from all text messages
Reply HELP: Text "HELP" for assistance or contact information

Important Notes:
Opting out of transactional messages may impact our ability to serve you effectively
You may opt out of marketing messages while still receiving transactional appointment reminders
After texting STOP, you will receive one final confirmation message
Supported Carriers
Our SMS service is supported by major carriers including AT&T, T-Mobile, Verizon, Sprint, and other participating carriers. Service availability may vary.
No Guarantee of Delivery
While we make every effort to deliver text messages promptly:
We do not guarantee delivery of text messages
Messages may be delayed or undelivered due to carrier issues, network problems, or device settings
You are responsible for ensuring your phone number is current and can receive messages
We are not liable for missed appointments due to undelivered text messages
Security and Privacy
Text Message Security:
SMS is not a secure form of communication
We will not send sensitive personal information (SSNs, credit card numbers, passwords) via text
Do not reply to text messages with sensitive personal information
Verify the sender before clicking links in text messages
Your Responsibility:
Keep your mobile device secure
Protect your phone from unauthorized access
Notify us immediately if your phone number changes
Report any suspicious messages claiming to be from The Notaryous LLC
TCPA Compliance
By providing your mobile phone number and consenting to receive text messages, you certify that:
You are the owner or authorized user of the mobile phone number provided
You are 18 years of age or older
You understand that consent is not required as a condition of purchase
You understand this consent applies to recurring automated text messages
This consent complies with the Telephone Consumer Protection Act (TCPA) and related regulations.
Updating Your Preferences
You may update your text message preferences at any time by:

Responding to specific opt-in/opt-out prompts in our messages
Third-Party SMS Service Providers
We may use third-party SMS service providers to deliver text messages. These providers are contractually obligated to protect your information and use it only for delivering our messages.
Fees and Payment
Service Fees
Notary fees are set according to Oregon and Washington state maximum allowable fees
Travel fees for mobile services are calculated based on distance and time
Rush or after-hours services incur additional fees
Fingerprinting fees vary by type of service and submitting agency requirements
All fees will be communicated clearly before service is rendered
Payment Terms
Payment is due at the time of service unless other arrangements have been made
We accept cash, credit/debit cards, Venmo, Zelle, and other electronic payments
Returned checks will incur a $35 fee plus any applicable bank fees
For loan signings, payment terms are established with the title company or signing service
Refund Policy
Services rendered in good faith are non-refundable
Refunds for cancellations are governed by our Cancellation Policy above
If documents are rejected by the receiving agency due to our error, we will re-notarize at no charge
Fingerprinting services: If prints are rejected due to technical error on our part, we will re-print once at no charge
Remote Online Notarization (RON) Specific Terms
Technology Requirements
By using our RON services, you confirm that you have:
A computer, tablet, or smartphone with camera and microphone
Reliable high-speed internet connection
A well-lit, quiet space for the session
Valid email address for receiving documents
RON Process
Identity verification will be conducted using credential analysis and knowledge-based authentication
Sessions will be audio-visually recorded as required by Oregon and Washington law
Recordings are retained for 10 years
You consent to being recorded as part of the RON process
We use Blue Notary as our RON platform provider
Technical difficulties may result in rescheduling without penalty
Security
You are responsible for maintaining the security of your login credentials
Do not share your RON session link with unauthorized parties
Verify you are on the legitimate Blue Notary platform before entering sensitive information
Fingerprinting Specific Terms
Service Delivery
We submit fingerprints electronically or by mail to the requesting agency
Processing times are determined by the receiving agency, not The Notaryous LLC
We are not responsible for delays or rejections by the receiving agency
Multiple attempts may be needed for individuals with worn or damaged fingerprints
Print Quality
We make every effort to capture high-quality prints
If prints are rejected due to quality issues not caused by our error, additional fees will apply for re-printing
Certain medical conditions, occupations, or age factors may affect print quality
Results and Records
We do not receive or have access to background check results
Results are sent directly from the agency to the requesting party
You must contact the requesting agency regarding your results
Record Retention and Access
Notary Records
We maintain a notary journal as required by law (10 years minimum)
RON recordings are retained for 10 years
Clients may request copies of journal entries related to their transaction (fees may apply)
Journal entries may be disclosed pursuant to legal process or as required by law
Fingerprinting Records
Fingerprint records are retained only as long as necessary for transmission to the requesting agency
We do not maintain permanent copies of fingerprint cards unless required by law or agency
Liability and Disclaimers
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Our liability is limited to the amount paid for the specific service
We are not responsible for the legal effect, validity, or enforceability of documents we notarize
We are not responsible for third-party rejection of notarized documents
We are not liable for consequential, indirect, incidental, or punitive damages
Our E&O insurance coverage is $100,000
No Guarantee of Results
We do not guarantee:
Acceptance of notarized documents by third parties
Acceptance of fingerprints by receiving agencies
Specific outcomes related to background checks
That documents will achieve your intended legal purpose
Document Review
You acknowledge that:
We do not review documents for legal sufficiency
We do not advise you on the content or effect of documents
You should consult an attorney if you have legal questions
We only verify identity, willingness, and awareness of signers
Refusal of Service
We reserve the right to refuse service if:
You cannot provide satisfactory identification
You appear to be under duress or coercion
You lack mental capacity to understand the transaction
Documents are incomplete or appear fraudulent
You are disruptive, threatening, or create unsafe conditions
The notarization would violate state law or our professional obligations
You have an outstanding unpaid balance with us
Technical requirements for RON cannot be met
No refunds will be issued for services refused due to the above reasons.
Confidentiality and Privacy
We maintain the confidentiality of your personal information in accordance with our Privacy Policy
We do not share your information with affiliates, partners, or subsidiaries (The Notaryous LLC operates as an independent business with no affiliates)
We do not disclose information about transactions except as required by law or to complete your requested services
Third parties (title companies, lenders, agencies) may receive only the information necessary to complete your specific service
We do not sell, rent, or trade your personal information for marketing purposes

Intellectual Property
All content on our website, marketing materials, and business documents, including text, graphics, logos, and software, is the property of The Notaryous LLC and protected by copyright and trademark laws.
You may not:
Reproduce or distribute our materials without permission
Use our business name, logos, or branding without authorization
Scrape or collect data from our systems
Third-Party Services and Links
We may use or reference third-party services (Blue Notary, payment processors, background check agencies). These third parties:
Have their own terms of use and privacy policies
Are not under our control
We are not responsible for their actions or services
Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Oregon without regard to conflict of law principles.
Jurisdiction and Venue
Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Washington County, Oregon.
Informal Resolution
Before filing any legal action, you agree to contact us to attempt informal resolution of the dispute.
Arbitration
For disputes involving amounts less than $10,000, you agree to binding arbitration in accordance with the rules of the American Arbitration Association.
Class Action Waiver
You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits.
Indemnification
You agree to indemnify, defend, and hold harmless The Notaryous LLC, its owner, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:
Your breach of these Terms
Your violation of any law or third-party rights
Your misuse of our services
False or misleading information you provide
Your failure to maintain confidentiality of sensitive documents
Force Majeure
We are not liable for failure to perform services due to circumstances beyond our reasonable control, including:
Acts of God (natural disasters, severe weather)
Pandemics or public health emergencies
Government actions or restrictions
Power outages or internet/technology failures
Labor disputes
Transportation disruptions
Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective when:
Posted on our website with an updated "Last Updated" date
Emailed to clients who have provided email addresses (for material changes)
Continued use of our services after changes constitutes acceptance of modified Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Notaryous LLC regarding our services and supersede all prior agreements or understandings.

You understand the limitations of notary and fingerprinting services
You have had the opportunity to ask questions or seek clarification
You understand we cannot provide legal advice
You consent to audio-visual recording for RON sessions
You agree to pay all applicable fees
The Notaryous LLC
Will send appointment reminders and follow ups to ensure efficiency and a positive experience.
You can cancel the SMS service at any time. Just text "STOP" to the 503-536-2326. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages as needed. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
